§1 General, scope of application
The online ordering of products is based on the following General Terms and Conditions (AGB) for online business.
By sending the online order, the user accepts these GTC.
Conflicting provisions of the customer’s general terms and conditions shall not apply.
These terms and conditions shall also apply to all future transactions with the customer, insofar as legal transactions of a related nature are involved.
§2 Conclusion of contract
The offers of TNCO Niedermann in the Internet shop are only valid for Switzerland and are subject to change and non-binding. The order of a customer via the Internet shop is considered a binding offer to TNCO Niedermann. The customer is obliged to provide truthful information when placing an order.
The contract is only concluded with the order confirmation from TNCO Niedermann.
§3 Prices, Payment, Due Date, Default of Payment
The price at the time of the order is decisive for invoicing.
The indicated prices include value added tax. Shipping and packaging costs are charged separately. TNCO Niedermann expressly reserves the right to change prices.
§4 Delivery, shipping costs
Parcels are usually shipped within 1-3 days via DPD.
Shipping only within Switzerland.
Shipping only to resellers.
Minimum order quantity: CHF 200.00
Surcharge for small quantities: incl. postage and shipping CHF 45.00
Delivery unit: We only deliver in packaging units (4 tea packs each)
Shipping: Free of charge from CHF 200.00 order value
§5 Reservation of title
The goods remain the property of TNCO Niedermann until payment has been made in full.
§6 Warranty
Claims for damages against TNCO Niedermann as well as against its employees are excluded, as long as there is no intentional or grossly negligent action.
§7 Revocation
The order can be cancelled as long as it has not been shipped.
§8 Data protection
The processing of personal data (names, postal addresses, telephone numbers, etc.), which the customer makes known to TNCO Niedermann in connection with the use of the online service, is subject to data protection legislation. Your data will not be passed on to third parties.
§9 Place of jurisdiction and applicable law
1 Only Swiss law is applicable.
2 The place of jurisdiction for all disputes arising from the contractual relationship is Zurich (CH).
§10 Miscellaneous
TNCO Niedermann reserves the right to adapt these general terms and conditions at any time. The customer will be informed of changes in a suitable manner, in particular through appropriate publications on the Internet pages of TNCO Niedermann.
§11 Severability Clause
Should one or more clauses of these general terms and conditions be ineffective, this does not result in the ineffectiveness of the entire contract. The invalid provision will be replaced by the relevant legal regulation.
